Introduction
Welcome to CardyShop, a marketplace dedicated to the buying and selling of collectible cards. By accessing or using our platform, you agree to comply with and be bound by these Terms and Conditions. We encourage you to read them carefully before using the website.
Services Provided
CardyShop allows users to:
- Register and create an account.
- Search for collectible cards.
- Create listings to sell their cards.
- View listings for a specific card.
- Purchase cards from different sellers.
User Registration
To register on CardyShop, users must:
- Use a Google account or email to register.
Becoming a Seller
Registered users can become sellers by completing:
- The Stripe onboarding process.
- Setting up an account linked to Stripe.
Once registered as sellers, users can both buy and sell on the platform.
How an Order Works
- After checkout, the buyer has 10 minutes to complete the payment. If the payment is not made within this time, the order will be automatically canceled.
- Once the payment is made, the seller has 7 days to ship the package and mark it as shipped on the platform. If not, the buyer will receive an automatic refund.
- After shipment, the buyer has up to 21 days to receive the package. If the package does not arrive within this period, the buyer has 2 days to open a dispute. If no action is taken, the package will be considered delivered, and the seller will receive the payment.
- If a dispute is opened, both the seller and buyer have 7 days to discuss in the dedicated chat. After this period, the order will be investigated by CardyShop to determine any refund (total, partial, or none). The review time depends on CardyShop.
- An order may contain multiple packages, where each package represents a separate shipment from a seller.
- A package is considered completed when it is marked as delivered, refunded, or partially refunded.
- An order is considered completed when all packages within it are completed.
Seller's Responsibilities
- Sellers are solely responsible for shipping their own cards.
- CardyShop is not responsible for issues such as counterfeit cards or failure to ship.
- Sellers must mark items as shipped within the platform to comply with automatic payment processes. Failure to do so may result in the payment being refunded to the buyer.
Buyer's Rights and Dispute Resolution
Buyers can open disputes for issues such as:
- Non-receipt of purchased items.
- Receiving counterfeit or damaged cards.
Disputes are assessed internally based on the evidence provided by both parties. Refunds may be granted partially, fully, or denied depending on the outcome. Refunds cover the cost of cards and shipping but exclude platform fees.
If the buyer enters an incorrect shipping address, they will not be entitled to a refund.
If an item or items need to be returned, CardyShop does not manage this process. The buyer and seller must agree privately on shipping costs and returns.
Platform's Responsibilities
CardyShop is committed to preventing fraud and ensuring secure transactions but does not assume responsibility for:
- Disputes between buyers and sellers. CardyShop provides a system for managing disputes and determines the outcome based on the evidence provided. However, it is not responsible for any consequences arising from the outcome of disputes between buyers and sellers.
- Losses arising from actions or omissions of users.
- Issues occurring outside the platform's automated processes.
Payment Processing
Payments are handled via Stripe. Users must adhere to Stripe's terms and conditions for all transactions.
User Conduct
Inappropriate behavior, including but not limited to the following, may result in account suspension or banning:
- Fraudulent activities.
- Insults or inappropriate language in reviews or chats.
- Violation of CardyShop policies.
Account Cancellation
Users may request account cancellation only if:
- There are no active orders in progress.
- The available balance in their Stripe-linked account is 0.
If these conditions are not met, the account cannot be canceled until any pending issues are resolved.
Listing Cancellation
- A seller can cancel a listing at any time.
- However, if there are active orders linked to the listing, these will not be canceled and must be completed. The seller will still be required to fulfill their shipping and delivery obligations.
Changes to Terms and Conditions
CardyShop reserves the right to update these Terms and Conditions as necessary. Changes will take effect immediately after being posted on this page with an updated date.
